Welcome to the Terms and Conditions page (“Terms”) of the website www.thuyennhieuloc.com (“Website”). These Terms govern your access to and use of the Website as well as the services provided through this platform. By continuing to use the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including the policies referenced herein.
These Terms, together with related policies such as the Privacy Policy, Booking Guarantee Policy, Cancellation and Refund Policy, Customer Review Guidelines, and Frequently Asked Questions (FAQ), constitute a legally binding agreement between you and Ben Noi Do. If you do not agree with any part of these Terms, please cease using the Website immediately.
These Terms are important as they stipulate:
The rules and conditions related to the use of the Website and the booking services provided by Ben Noi Do;
The method of resolving disputes that may arise from the use of the Website.
Before registering an account and/or using any services on the Website, you should carefully read these Terms.
Please note that accessing the content of the Website may not be legal for certain individuals in certain jurisdictions. We do not warrant that all content on this Website is appropriate or available for use in all countries/territories where the Website may be accessed.
When we refer to “Ben Noi Do,” “we,” “us,” or “our” in these Terms, we mean Thuyen Nhieu Loc Company Limited and its affiliates. Ben Noi Do operates a platform that allows you to explore, search for, and reserve various products and services offered, marketed, and/or operated by us and third parties (“Travel Providers”), which may include but are not limited to:
Combinations including but not limited to transportation, temporary accommodation, activities, and experiences (“Tours”);
Boats for charter, with limited purposes of use (“Boat Rentals”);
Other activities and experiences (“Activities”).
(each a “Travel Product”), through a convenient portal, the support of which is individually and collectively referred to as our “Services.” You can access our Services through our website (“Website”). In some cases, we work with our affiliates and other third-party partners (“Partners”) to help list accommodation information and book certain Travel Products. For example, some online bookings for Travel Products on our Platform are supported by our Partners, including but not limited to Klool, Viettravel, Mekong Riverside Boutique Resort & Spa, Hue Riverside Boutique Resort & Spa. In these cases, the Terms and Conditions of Use and/or privacy policies of the Partner will govern the relationship between you and our Partner for the booking of the relevant Travel Product(s), instead of Section B of these Terms. We may be paid a fee or commission by a Partner or Partners if you book such Travel Product(s). When we use “you,” “your,” or “User,” we refer to anyone who accesses or uses our Platform and Services. If you have any questions, comments, complaints, or claims regarding our Platform or these Terms, you can contact us here.
This online Platform is owned by Ben Noi Do and our licensors. We grant you only a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access the Platform to experience the Services for personal, non-commercial purposes, in accordance with these Terms. Apart from the limited right to use mentioned above, all other rights and licenses are reserved by us. You represent and warrant that your access to and use of the Platform is solely for your personal, non-commercial needs.
Users of the Platform must be 18 years of age or older (or have reached the age of majority as stipulated in their country/territory) and possess full civil capacity to enter into contracts; otherwise, the consent of a legal guardian is required. This age requirement also applies even if you only access the Platform to consult information without making a booking request.
You agree not to use the Platform for any unlawful purpose, prohibited by these Terms, or outside the scope intended by us. Specifically (but not limited to), you undertake not to:
3.3.1 Resell products/services booked through the Platform or exploit them for commercial purposes without the written consent of Ben Noi Do.
3.3.2 Make fictitious, fraudulent, or speculative bookings.
3.3.3 Falsify or intentionally misrepresent the Platform, including deleting, modifying, or replacing copyright notices, trademarks, logos, or other source information.
3.3.4 Use software or automated/manual tools to monitor, copy, extract, store, or index any content on the Platform (text, images, audio, video, reviews, data, etc.).
3.3.5 Decipher, reverse engineer, disassemble, or interfere with any software/application of the Platform, or attempt to access source code.
3.3.6 Disrupt the Platform, servers, or networks connected to the Platform.
3.3.7 Engage in cyber security breaches, including cracking passwords, encryption, transmitting or storing illegal data, or collecting personal/login information of other users.
3.3.8 Attempt to gain unauthorized access to the systems of Thuyen Nhieu Loc Company Limited.
3.3.9 Embed (iframe), copy, or directly link any part of the Platform to another website (including booking links) without our written consent.
3.3.10 Upload or transmit defamatory, obscene, fraudulent, misleading, harassing, or malicious code (malware, viruses, trojans), as well as spam or unsolicited advertising messages.
3.3.11 Impersonate formatting (e.g., modifying packet headers) to conceal the origin of content you send.
3.3.12 Engage in any conduct that may harm or negatively impact the Platform, Ben Noi Do, or Thuyen Nhieu Loc Company Limited.
3.3.13 Violate applicable laws or infringe upon the intellectual property rights and legal rights of us or third parties.
If, based on your conduct, Ben Noi Do has reasonable grounds to suspect that you have violated any of the above, we have the right to:
Lock the user account; and/or
Refuse to apply loyalty benefits, promotions, or other offers.
When using the Platform, you may need to create and maintain a user account with us (“Ben Noi Do Account”). During the registration process, you agree to provide accurate, up-to-date, and complete information, and ensure the accuracy of this information is maintained throughout your usage. When creating a username, you agree not to use the name of another person with the intent to impersonate, or choose a name that contains trademarks or intellectual property of a third party without valid authorization from the owner.
You are solely responsible for maintaining the confidentiality of your Ben Noi Do Account login information and password, as well as all activities that occur through that account – including any incurred costs. We have the right to consider anyone using your login information as authorized by you and are not obligated to verify the identity or legality of actions taken through the account. Nevertheless, at our sole discretion, we may refuse to act on any request originating from the account and conduct investigations to verify the user, request, or related behavior. If you suspect unauthorized access to your account, password disclosure, or detect a security incident, you must notify us immediately.
We are not responsible for any loss or damage arising from your failure to comply with the regulations in this Article 4. To the extent permitted by law, we have the right to refuse to grant or unilaterally terminate your existing account without prior notice and without any liability.
We reserve the right to prevent or limit a User’s access to part or all of the Platform – whether temporarily or permanently, at our sole discretion. If blocked, you are not permitted to attempt to access the Platform again by using a different username or having someone else access it on your behalf.
To facilitate the usage process, we allow you to log in with your Google account. By choosing this option, you signify your acceptance of:
Ben Noi Do’s Terms of Service; and
Google LLC’s Terms of Service.
Using this login option also means that you allow us to access basic information from your Google account (e.g., name, email, profile picture) for the purpose of verifying your identity and providing a more personalized service experience.
We do not guarantee the truthfulness, accuracy, or completeness of any Content appearing on the Platform – including information provided by Users or Travel Providers. The publicly displayed prices of Travel Products are dynamic and may change before, during, or after your search. The price of a Confirmed Booking (defined below) will not be affected by any price list changes after the time of confirmation. All data related to Travel Products – such as reviews, ratings, comments – are provided by the Travel Provider or their representatives (distributors, channel managers, partners). We also do not guarantee that the Content on the Platform has not been modified due to technical errors or unauthorized actions by third parties.
Your access to and use of any Content on the Platform is at your own risk, and you are solely responsible for any loss or damage arising to any related party. In no event shall Ben Noi Do be liable for any loss, damage, error, omission, or addition to, subtraction from, or modification of the Content – whether directly or indirectly. We do not warrant that the Platform will always be available, continuous, or uninterrupted; and are not responsible for any loss or damage resulting from the suspension or interruption of the Platform or Services.
The Platform is not a recommendation or endorsement of any Travel Product or Travel Provider listed. We disclaim all representations, warranties, or guarantees regarding the quality, condition, features, or suitability of any Travel Product/Travel Provider. From time to time, we may implement programs that allow Travel Providers to enhance the visibility of their Products – for example, through Sponsored Listings. Such prioritized listings will be clearly marked or accompanied by an identifying note.
Now moving on to section 6:
To the extent that the Platform allows you to upload, share, or transmit any content, including but not limited to comments about Travel Products (“User Content”), you understand and agree that:
6.1.1 You are solely responsible for the User Content you post, and you undertake not to share false, misleading, discriminatory, or infringing information on the legitimate rights of any third party – including privacy rights, intellectual property rights, or property rights.
6.1.2 Any User Content you provide will not be considered confidential or proprietary, and will comply with the current Review Guidelines, including the Guest Review Guidelines (if applicable).
6.1.3 You must not include personal information in User Content, unless such use is lawful and in accordance with our Privacy Policy and applicable data protection regulations.
6.1.4 Although you or your licensor retain intellectual property rights to the User Content, you grant us and our affiliates a global, non-exclusive, royalty-free, transferable, and sub-licensable license to use such content in any form (including electronic and non-electronic), for purposes such as: storing, displaying, copying, distributing, modifying, publishing, translating, creating derivative works, and promoting and marketing the Platform – with or without your name. At the same time, you waive all moral rights related to this content, to the extent permitted by law.
6.1.5 You authorize us to take legal action on your behalf against any individual or entity that infringes upon rights related to your User Content.
6.1.6 Your sharing of User Content shall not be construed as an endorsement or official affiliation between you and Ben Noi Do.
6.1.7 We are under no obligation to store, publish, share, or maintain User Content, and you will be responsible for backing it up if necessary.
For the avoidance of doubt, we have the sole right (at our sole discretion) to remove any User Content if that content:
Violates the Guest Review Guidelines;
Is contrary to these Terms;
Violates the law;
Or, in our assessment, may cause harm to us, other Users, or third parties.
We will notify you of the reason for removing content, unless we believe that notification:
a) May violate the law, directives from regulatory authorities, or create legal risks; b) May affect the investigation process or operation of the Platform; c) May harm Users, third parties, us, or related Partners.
Hyperlinks on our Platform to websites operated by third parties are provided for your reference only. Ben Noi Do does not control the content, access rights, or privacy policies of those websites and is not responsible for any content, services, or information provided on those websites.
If you click on a third-party link or advertisement, you will leave our Platform, and any personal data you provide will be processed in accordance with the relevant third party’s cookie and privacy policies. We recommend that you read these policies carefully before proceeding.
Ben Noi Do is not legally liable for any damages arising from accessing those websites, including but not limited to risks from viruses, spyware, malware, or system corruption. We also do not endorse, recommend, or guarantee these websites or any content posted on them.
Any third party wishing to create a link to our Platform must notify Ben Noi Do of this intention in advance. We have the sole right to refuse or disallow the establishment of such a link.
In the event that we approve, this does not imply that Ben Noi Do must establish a reciprocal link or a mutual relationship with that third party.
When you make a booking for a Travel Product through our Platform, it means that you are registering to use services directly owned, managed, and operated by Ben Noi Do. We are fully responsible for the Travel Products booked and are committed to handling any issues or incidents during the service usage or throughout your trip.
When you submit a Booking Request through the Platform, you are proposing to enter into a booking contract for the Travel Product(s) under these Terms of Use. The contract is only effective when you receive an official confirmation email from Ben Noi Do, referred to as a “Confirmed Booking.” Please note that the “Thank You” page displayed after you complete the Booking Request is merely a notification that we have received the request – not an official booking confirmation.
We will provide you with a confirmation code in the booking confirmation email. Please keep this code carefully. Ben Noi Do is not responsible in the event that the confirmation code or booking voucher is lost, stolen, or destroyed.
Unless restricted by applicable law, Ben Noi Do has the sole right to refuse any Booking Request or cancel a Confirmed Booking without providing a specific reason. If you have made a prior payment, the amount will be refunded in accordance with our Refund Policy, except in one of the following cases:
8.4.1 You violate the Terms of Use or relevant laws;
8.4.2 The terms of the Travel Provider do not allow refunds;
8.4.3 Based on internal assessment, we determine that you are not eligible for a refund, including but not limited to cases of suspected fraud or system abuse.
Here’s the English translation for sections 9 and 10:
Ben Noi Do may implement promotional programs periodically or for specific events, including but not limited to: discount codes, early booking offers, complimentary services, or group discounts. These programs may apply to all or part of the Travel Products depending on the specific period.
You can only use promotions if you fully meet the conditions clearly stated in each program, including but not limited to: applicable time, minimum number of people, payment method, or tour booking channel. Each offer is valid for one-time use only, unless otherwise stipulated.
Promotional offers are not redeemable for cash, non-refundable, and non-transferable to others without written permission from Ben Noi Do.
In the event that you change or cancel a booking that has applied a promotion, Ben Noi Do has the right to refuse to reapply the offer and adjust the costs accordingly based on current policies. Refunds (if any) will only apply to the actual value you paid after deducting the promotional discount.
Ben Noi Do reserves the sole right to change, suspend, or terminate any promotional program without prior notice if signs of fraud, system errors, or other objective factors affecting the fairness or effectiveness of the program are detected.
We are not responsible if the promotional program cannot be implemented due to force majeure events including but not limited to: natural disasters, war, epidemics, technical incidents, or legal changes beyond the reasonable control of Ben Noi Do.
All tour prices displayed on the Platform include basic costs according to the program as described. However, some surcharges may apply depending on your individual requests or actual conditions at the time of service use, including but not limited to:
Single room surcharge;
Fees for upgrading accommodation or transportation services;
Surcharge for foreign guests (if required by the destination);
Fees for requesting itinerary changes outside the confirmed tour program.
Tour prices may not include mandatory taxes (such as VAT, environmental tax, service tax, etc.) depending on the regulations of each destination or supplier. These taxes, if applicable, will be clearly listed during the payment process, and you are responsible for paying these taxes in full before the departure date.
In the event of changes in foreign exchange rates, fuel prices, tax policies, or other input costs from the supplier, Ben Noi Do has the right to adjust the tour price and corresponding surcharges accordingly. We will provide advance notice and will only collect additional costs with your consent.
We are committed to providing complete information regarding any fees and taxes incurred during the service booking process. You should carefully read the conditions and contact Ben Noi Do if you need further clarification before confirming payment.
When you submit a tour booking request through our Platform, you are not required to make an upfront payment at the time of booking. Your booking will be recorded by us as a temporary Reservation Request and is not considered a final confirmation.
After receiving your reservation request, a Ben Noi Do consultant will proactively contact you using the information provided (phone, email, etc.) to:
Reconfirm tour information and specific needs;
Inform you of the current reservation status;
Guide you through suitable payment methods and deadlines.
You can choose one of the following payment methods after your reservation is confirmed:
Bank transfer;
Cash payment at the company office;
Payment via e-wallet.
The reservation is only valid for a specific period communicated by the consultant. If payment is not completed according to the instructions within the deadline, we have the right to cancel the reservation without prior notice.
Only when you complete the payment as instructed will Ben Noi Do send an official electronic confirmation and your reservation will be converted into a Confirmed Booking.
Any requests for cancellation, changes, or refunds related to tour bookings will be processed according to the detailed cancellation, change, and refund policy stipulated and published on our Platform. Please refer to and comply with the regulations in this policy to ensure your rights when you need to change or cancel services.
13.1. Customers commit to providing accurate, complete, and timely information when registering for tour bookings. Any errors or omissions provided by the customer may affect their rights and the service process.
13.2. Customers are responsible for complying with the regulations, instructions, and rules of the company as well as relevant parties throughout the tour participation.
13.3. Customers are responsible for safeguarding their personal belongings, identification documents, and necessary items throughout the trip.
13.4. Customers undertake not to use the services for illegal purposes, in violation of local customs and traditions, or in a way that negatively affects other members and the organizing unit.
13.5. All customer statements, feedback, or complaints must be presented truthfully, clearly, and responsibly so that the company has a basis for appropriate handling.
14.1. All content, images, designs, text, documents, and related products posted on our Platform are the intellectual property of Ben Noi Do or authorized parties. Any unauthorized copying, use, distribution, or exploitation is strictly prohibited and may be handled in accordance with the law.
14.2. Customers undertake not to use any content or materials that are the intellectual property of Ben Noi Do for commercial or non-commercial purposes without our prior written consent.
14.3. Any complaints regarding intellectual property infringement related to content on the Platform or during the service provision should be sent in writing or by email to Ben Noi Do’s official contact address, along with the following information:
Complainant Information: Full name, contact address, phone number, email address.
Details of the Infringed Work or Content: Title of the work, description, proof of ownership.
Information about the Infringing Act: Detailed description, time, location, and related evidence.
Specific Request for Handling: For example, removal of infringing content, compensation for damages, or other measures.
Signature or confirmation of the complainant (if sending a hard copy or scanned file).
14.4. Ben Noi Do is committed to receiving and handling intellectual property infringement complaints seriously, fairly, and in compliance with current legal regulations.
14.5. In the event that infringement is determined, Ben Noi Do has the right to request the infringing party to cease the infringing act, compensate for damages, and take necessary legal measures to protect its legitimate rights.
15.1. Ben Noi Do has the right to terminate or temporarily suspend service provision to customers if they violate the terms of this agreement or engage in conduct that adversely affects the operation of the Platform and services.
15.2. Customers have the right to request termination of services by providing prior written notice as stipulated in the contract or as instructed by Ben Noi Do.
15.3. Upon termination of the contract or service agreement, all rights and obligations between the parties will cease, except for obligations that are stipulated to continue after termination (e.g., outstanding payment obligations, confidentiality of information).
15.4. Termination does not affect the right to claim damages or other legitimate rights of the parties arising before the time of termination.
16.1. Ben Noi Do will strive to provide services accurately, safely, and continuously. However, we do not guarantee that the service will always be uninterrupted, free from technical errors, or completely accurate and complete.
16.2. Ben Noi Do shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or other losses arising from the use or inability to use the service or related content.
16.3. Ben Noi Do is not responsible for any loss or damage arising from causes beyond our reasonable control, including but not limited to natural disasters, third-party system errors, illegal acts of third parties, or unexpected technical incidents.
16.4. Any legal liability of Ben Noi Do, if any, will be limited to the extent permitted by law and shall not exceed the value of the services paid for by the customer.
17.1. The collection, use, protection, and management of customer personal information are carried out in accordance with Ben Noi Do’s Privacy Policy, which is published and updated on our Platform.
17.2. Please refer to the detailed Privacy Policy to understand how we process personal information and the rights of customers regarding their personal data.
17.3. Ben Noi Do is committed to protecting the personal information of customers and will only use this information for the purpose of providing services as agreed.
